The IAAF has been successful in its appeal to the Court of Arbitration for Sport (CAS) in the case of Mr. Eddy Hellebuyck (USA).
Following a December 2004 decision of the North American Court of Arbitration for Sport (NACAS), Mr Hellebruyck received a two year suspension after testing positive for recombinant human Erythropoietin (rhEPO)
The IAAF appeal to CAS was based on the imposition by the NACAS of a commencement date for the period of ineligibility which was inconsistent with the applicable IAAF Rules.
The IAAF appeal was upheld by the CAS in a de novo hearing of all facts and issues in the case and copy of the full reasoned award will be published on the CAS website once available. However the CAS has ruled on the following points.
1. Upon appeal by the IAAF the decision by the NACAS dated 9 December 2004 is set aside.
2. The Respondent, Eddy Hellebuyck, has committed an anti-doping rule violation under rule 60 (2)(a) of the IAAF Rules 2002-2003.
3. The Respondent is declared ineligible for a period of two years. The period of ineligibility commences on 30 November 2004 and ends upon expiry of 29 November 2006.
4. Any competition results between 31 January 2004 and the date of the hearing on 30 November 2004 are eliminated under Rule 59 (4) of the IAAF Rules 2002-2003.
